Foster care homes are licensed according to statutes and rules defined by the MN Department of Human Services. See the State of Minnesota Administrative Rules at Office of the Revisor of Statutes website for Chapter 9555, Social Services for Adults and Minnesota Statutes Chapter 245A Human Services Licensing.
Adult foster providers are viewed as small business owners who provide a service. Providers should have an understanding of the needs of care for persons in placement, as well as the business knowledge to be able to manage self-employment business management needs, Medical Assistance billing and record keeping. Applicants will need to complete Adult Foster Care Orientation training, requirements of the Vulnerable Adults Act and Applicant Background Studies prior to licensure. Most applicants will also need to become enrolled as a Minnesota Health Care Provider prior to accepting residents. Depending upon the type of residents the program will serve, applicants may also need to be licensed under other DHS programs under MN 245D.
