Document Recording Information

Please check the following before sending in for recording:

  • Document dated
  • Document signed
  • Properly notarized
  • Complete, full legal description (not tax statement legal description)
  • Exhibits are attached
  • Name & address of who drafted the document
  • Correct filing fees submitted (see Recorder’s Fee Schedule)

If the land is Torrens property, please indicate this when submitting it for recording, per the following statute:

508.76 Subd. 2. Documents misfiled. The registrar may reasonably rely on the affirmative representation of the party presenting instruments for filing as to whether the land described in the instruments or any part of it is registered or unregistered. A party who requests that misfiled instruments be refiled with the registrar is responsible for paying any additional fees required to properly file any instrument misfiled because of an incorrect representation and, if applicable, to enter a new certificate of title.

TRANSFER DEEDS

  • State deed tax included (.0033 x sales price = deed tax due)
    OR
    Statement on the deed that the total consideration is $3,000 or less, with the minimum of $1.65 included
  • Completed eCRV for consideration over $3,000, with the eCRV number noted on the document
  • Name & address of where tax statements should be sent
  • All delinquent taxes have been paid
  • If the deed results in the split of a tax parcel, all current taxes must be paid
  • Well status indicated on the deed, with the well certificate and the $54.00 fee included, if applicable

RE-RECORDED DOCUMENTS

  • ·         Original document with the recording cover sheet attached
  • ·         New cover page added stating the reason for re-recording, with space provided for new signatures and notarization

CORRECTIVE DOCUMENTS

  • ·         Newly signed document
  • ·         Corrective statement included, referring to the previous recording and specifying what is being changed
